Welcome to Ora Tracker (the “Service” or the “App”). The Service is a mobile application designed to help users stay connected with the people they care about by sharing location information.

Please read these Terms and Conditions of Service (the “Terms”) carefully before using the Service. By creating an account or using any part of the Service, you (the “User”) acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1.1. Formation of Agreement: A legal agreement between you and us (the providers of Ora Tracker) is formed once you successfully complete the account verification process within the App. You acknowledge that these Terms are binding and agree to adhere to them.
1.2. Core Principle: Informed Consent
The Service is intended for use only on devices that you own, or on devices for which you have received the explicit, informed consent of the device owner to monitor. You represent and warrant that you will not use the Service for any unauthorized, illegal, or privacy-invading surveillance activities. You are solely responsible for any legal liability and consequences arising from your violation of this principle.
1.3. Age Requirement: The Service is intended for use by individuals who are at least 16 years old. If you are under the age of 16, you may only create an account or use the Service with the consent and under the supervision of a parent or legal guardian. By using the Service, you confirm that you meet this age requirement or have obtained the necessary parental consent.
1.4. Device and Network Requirements: You are responsible for ensuring your device meets the technical requirements to run the App, has an internet connection, and has necessary services (like location services) enabled. You are solely responsible for any charges (such as mobile data fees) incurred from your network provider.
2.1. Account Creation and Accuracy: You must provide valid and accurate information (such as your mobile phone number and name) to create an account. You are responsible for keeping this information up-to-date. Providing false information may result in the suspension or termination of your account.
2.2. Account Security: You are fully responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach and take steps (such as changing your password) to secure your account.
2.3. Password Protection: We strongly recommend using a strong password that includes a combination of letters, numbers, and symbols, and changing it periodically to protect your account.
3.1. Fair Use: The Service is for personal, non-commercial use only. Any unauthorized commercial exploitation, such as reselling accounts or the Service, is strictly prohibited.

3.3. Reporting Misconduct: If you become aware of any user violating these Terms, please report it to our support team. We will investigate and take appropriate action.
4.1. Content Ownership and License: You retain ownership of the content you share or upload through the Service (e.g., text, location data, herein “User Content”). However, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, display, and distribute your User Content for the purposes of operating, improving, and promoting the Service.
4.2. Content Guidelines: You may not upload or share any content that is illegal, offensive, contains hate speech, is pornographic, defamatory, or infringes on third-party intellectual property rights.
4.3. Right to Moderate: We reserve the right to review, moderate, or remove any User Content that violates these Terms or that we deem inappropriate, without prior notice. We may also suspend or terminate the accounts of repeat violators.
4.4. Responsibility for Content: You are solely responsible for your User Content. You agree to indemnify us against any third-party claims arising from your User Content.
5.1. Free & Paid Features: The App's basic features are free to use. Access to premium features may require a paid subscription plan. By subscribing, you agree to the relevant payment terms and fees.
5.2. 14-Day Right of Withdrawal: You have the right to withdraw from your subscription contract within 14 days of purchase without providing a reason. To do so, you must send a formal notice of withdrawal to our support email at phonetracker.feedback@outlook.com.
5.3. Refund for Service Issues: If the Service experiences continuous technical failures or disruptions that render it unusable, you may be eligible for a refund for the affected period. You must contact our support team within 30 days of your purchase and provide evidence (e.g., screenshots). We reserve the right to attempt to resolve the issue within a reasonable time before processing a refund.
5.4. Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel beforehand. We will notify you of any price or term changes at least one month before renewal.
5.5. Cancellations: You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing cycle, and you will not be refunded for the remainder of that period.
5.6. App Store Purchases: For subscriptions purchased through the Apple App Store, all refund and cancellation requests must be made directly to that platform and are subject to its policies.
Our collection, use, and protection of your personal data are governed by our Privacy Policy. By using the Service, you agree to the terms of our Privacy Policy.
The Service and all its contents, including software, design, text, graphics, logos, and trademarks, are our property or the property of our licensors and are protected by international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes only.
8.1. "As Is" Basis: The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2. Service Availability: We do not guarantee that the Service will be uninterrupted, timely, or error-free. The availability may be affected by third-party factors beyond our control (e.g., network providers, GPS signals).
8.3. Location Accuracy: The location data provided by the Service is an approximation. Its accuracy depends on various factors like device performance, network conditions, and environment, and it may be delayed, inaccurate, or unavailable at times. We are not liable for any damages arising from inaccuracies in location data.
8.4. Non-Emergency Use: The Service is intended as a supplemental communication tool and is not suitable for preventing or responding to emergencies. In an emergency, please use traditional emergency channels (e.g., calling 911 or local emergency services).
9.1. To the fullest extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits or data) arising from or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
9.2. In cases of slight negligence, our liability (where permissible by law) is limited to an amount not exceeding the total fees paid by you for the Service during the six (6) months preceding the event giving rise to the claim.
9.3. This limitation of liability does not apply to damages caused by our gross negligence, willful misconduct, or in cases of injury to life, body, or health.
You agree to indemnify and hold us, our officers, directors, employees, and agents harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Service; or (c) your violation of any third-party rights.
11.1. Termination by You: You may stop using the Service and cancel your subscription at any time.
11.2. Termination by Us: We reserve the right to suspend or permanently terminate your access to the Service at any time, without notice and without a refund, if we believe you have materially breached these Terms (especially the “Informed Consent” principle in Section 1.2).
12.1. Applicable Law: These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
12.2. Jurisdiction: You agree to submit to the exclusive jurisdiction of the competent courts for the resolution of any disputes arising from these Terms.
13.1. Amendments to Terms: We reserve the right to modify these Terms at any time. We will notify you of any material changes via in-app notification or email. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
13.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
13.3. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
